Processing and Protection of Personal Data
As Kamsan Chair, we would like to emphasize our sensitivity regarding the security of your personal data. In accordance with Article 10 of the Personal Data Protection Law No. 6698 (KVKK), data belonging to potential customers and all individuals using our web/mobile site are collected, processed, and stored by our company in compliance with KVKK principles as the Data Controller. All information within the scope of the Obligation to Inform is provided below.
Purpose of Collecting and Processing Personal Data
Your personal data may be collected and processed automatically or verbally through our offices, call center, website/mobile site, e-mail, social media platforms, and similar channels. The personal data collected (such as your Turkish ID number, ID serial number, place/date of birth, name/surname, contact details like e-mail address, phone number, and address) are processed for the following purposes:
- To ensure you benefit at the highest level from the services provided through our web/mobile platforms,
- To improve, update, and respond to the infrastructure, support, and sales services provided by our company,
- To record all contact information to maintain communication with our customers,
- For the establishment, validity, and termination of employment or service contracts,
- To process identity and contact details required for invoicing and, in case of credit card payments, to forward your credit card information securely to the payment institution. (Credit card details are not stored within our company.)
- To conduct market research, provide information on advertising, promotions, and campaigns related to our products and services,
- To record and process data related to your sales, transactions, and e-commerce activities on our systems,
- To fulfill legal obligations and manage legal disputes and responsibilities,
- To inform customers about our services via our business partners and solution providers,
- To respond to your questions submitted via e-mail, support systems, written or verbal channels, in accordance with Articles 5 and 6 of the KVKK.
Upon Establishment of an Electronic Commerce Agreement;
- Your identity information (name, surname, place/date of birth, Turkish ID Number),
- Your contact details (address, e-mail address, phone number),
- If you request an invoice, your Turkish ID Number, Tax ID Number, and Tax Office details,
- If you pay by credit card, your payment data will be processed and securely transmitted to the payment institution,
- If you choose bank transfer as the payment method, your IBAN and banking details.
If You Are a Registered User;
- Your unique username and password,
- Records related to services provided by our company (request and complaint management),
- Records created from submitted complaint forms,
- If you are using our e-commerce infrastructure, data processed by Kamsan solely for storage and system operation purposes (without determining the purpose or means of processing),
- Since you are a tradesperson or merchant, your contact data processed for sending commercial messages, offers, and campaign notifications.
To Whom and For What Purpose Personal Data May Be Transferred
Your personal data may be shared within the scope of our company’s activities with domestic or international business partners, cloud storage companies, payment intermediaries, contracted banks, agencies, advertising and marketing companies for promotional and communication purposes, as well as with legal, financial, and tax consultants, and other third-party business partners. As a Data Controller, our company exercises full legal diligence and transparency regarding the purposes and parties to whom personal data may be transferred. Persons providing their personal information to our company are deemed to have given explicit consent to this.
Method and Legal Basis of Collecting Personal Data
Your personal data are collected and processed by our company electronically, in writing, or verbally for the purposes stated above. They are collected and processed in order to fulfill all legal responsibilities related to the establishment and execution of contracts within the framework of applicable laws and regulations.
Rights Arising from the Personal Data Protection Law
- To learn whether personal data is being processed,
- To request information if personal data has been processed,
- To learn the purpose of processing and whether it is used in accordance with that purpose,
- To know the third parties to whom personal data are transferred domestically or abroad,
- To request correction of incomplete or incorrect personal data,
- To request deletion or destruction of personal data under the conditions set forth in Article 7,
- To request that the transactions carried out pursuant to subparagraphs (d) and (e) be notified to third parties to whom personal data has been transferred,
- To object to the emergence of a result against oneself by analyzing the processed data exclusively through automated systems,
- To demand compensation for damages incurred due to unlawful processing of personal data.
